About the Opportunity
The Company is currently seeking an Intellectual Property Counsel, reporting directly to the Vice President, Global Intellectual Property to join our Intellectual Property team based in Houston, TX or Boston, MA. In addition to providing legal advice related to intellectual property matters, this role will also contribute to the development and growth of other lawyers in the legal department and members of the Intellectual Property team to ensure the highest quality of legal services and compliance are provided. The person serving in this role needs to be a leader that can provide strategic IP advice and planning, as well as leadership on the implementation of business strategies.
Roles and Responsibilities
The ideal candidate will contribute to the implementation of the company’s overall strategy for the protection of intellectual property. Duties include but are not limited to:
- Supporting the company’s IP strategy and engaging in activities to enhance the company’s IP portfolio.
- Drafting, reviewing and negotiation legal documents, including joint development agreements.
- Performing due diligence relating to acquisition of technology.
- Managing the preparation and prosecution of patent and trademark applications, including coordination with outside US and foreign counsel.
- Participating in one or more patent committees.
- Managing patent office proceedings, e.g., oppositions, IPRs and other adversarial proceedings in patent offices and courts.
- Conducting and managing freedom-to-operate studies to avoid patent disputes, including infringement analysis and competition patent portfolio analyses.
- Ensuring that internal worldwide clients are fully aware of the significance of intellectual property matters, including providing intellectual property training.
- Resolving legal issues and providing legal advice and counsel in relation to intellectual property matters.
Eligibility Criteria
- Bachelor’s Degree or higher in engineering or related technology field, and energy and/or chemicals technologies experience preferred.
- U.S. qualified lawyer (J.D.) with current state license.
- Registered to practice as patent attorney before the U.S. Patent and Trademark Office.
- Minimum 5+ years active practice within the intellectual property field (8+ preferred), including preparing and negotiating joint development and license agreements and other intellectual property related contracts, experience in preparation and prosecution of patent applications in the U.S. and/or in other jurisdictions, evaluating and preparing patent opinions, and supporting litigation of patents and other intellectual property disputes.
- Ability to recognize the business consequences of legal advice.
- Strong advocacy skills.
- Excellent written and oral communication skills including the ability to communicate and interact effectively at all levels of the organization.
